By creating an account, accessing, browsing, or using any feature of the ClawRent platform ("Platform", "Service", "ClawRent", "we", "us", or "our"), whether as a guest or registered user, you ("User", "you", "your") acknowledge that you have read, fully understood, and expressly agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any other policies or guidelines incorporated herein by reference.
If you are using ClawRent on behalf of a business, organisation, or legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" in these Terms refers to both you personally and that entity.
⚠️ If you do not agree with any part of these Terms, you must immediately cease using the ClawRent platform. Continued use constitutes unconditional acceptance.
These Terms constitute a legally binding agreement between you and ClawRent. We encourage you to print or save a copy of these Terms for your records.
For the purposes of these Terms and Conditions, the following definitions shall apply:
- "Platform" means the ClawRent website, mobile application, and all associated services, tools, and features made available by ClawRent.
- "Owner" means any registered user who lists, manages, or administers one or more properties on the Platform.
- "Tenant" means any registered user who rents, occupies, or applies to rent a property listed on the Platform.
- "Worker" means any registered user who offers maintenance, repair, or property-related services through the Platform's job board.
- "Property" means any real estate listing posted on the Platform, including long-term rentals, short-stay accommodation, and properties listed for sale.
- "Rent Payment" means any monetary transaction processed through the Platform for the purpose of paying rent between a Tenant and an Owner.
- "Subscription" means any paid recurring plan purchased by a User to access premium features such as verified badges.
- "Verified Badge" means a credibility indicator granted to a User upon successful payment and verification through ClawRent's subscription tiers.
- "Content" means any text, images, documents, data, or other material submitted, uploaded, or posted to the Platform by any User.
- "Third-Party Service" means any external platform, provider, or tool integrated with ClawRent, including payment processors, cloud storage providers, and communication services.
ClawRent is a cloud-based property management and rental platform designed to connect property owners, tenants, and maintenance workers in a single, unified environment. The Platform provides the following core services:
3.1 Property Management
Owners may list, manage, and monitor residential and commercial properties. Tools include property photo uploads, lease document management, tenant assignment, inspection scheduling, and property analytics.
3.2 Tenant Services
Tenants may search for available rental properties, submit rental applications, sign digital lease agreements, pay rent online, track their payment history, submit maintenance requests, and communicate with their landlord through the in-platform messaging system.
3.3 Worker / Job Board
Property owners may post maintenance and repair jobs. Registered Workers may browse and apply for these jobs. ClawRent facilitates the connection but is not a party to any employment or service agreement formed between an Owner and a Worker.
3.4 Short-Stay Listings
Owners may list properties for short-term accommodation. Guests may browse, book, and pay for short-stay rentals through the Platform.
3.5 Subscription Plans
Users may purchase Verified Badge subscriptions to enhance their credibility and visibility on the Platform. Plans are available for Tenants, Owners, and Workers at different price points.
3.6 Communication Tools
The Platform includes an internal messaging system, notification centre, and lease analysis tools to facilitate communication between parties.
ClawRent reserves the right to add, modify, suspend, or discontinue any feature or service at any time, with or without notice.
4.1 Age Requirement
You must be at least 18 years of age to create an account or use the ClawRent platform. By registering, you represent and warrant that you are 18 years of age or older. ClawRent reserves the right to terminate any account that is found to belong to a person under the age of 18.
4.2 Account Registration
To access the full features of ClawRent, you must register for an account. During registration, you agree to:
- Provide accurate, current, truthful, and complete information as prompted by the registration form
- Select a user role that accurately reflects your intended use of the Platform (Owner, Tenant, or Worker)
- Maintain and promptly update your account information to keep it accurate and current at all times
- Keep your login credentials confidential and not share them with any third party
- Accept full responsibility for all activities that occur under your account
- Notify ClawRent immediately at clawrentapp@gmail.com if you suspect any unauthorised access to or use of your account
4.3 Account Security
You are solely responsible for maintaining the confidentiality of your password. ClawRent will not be liable for any loss or damage arising from your failure to protect your account credentials. We strongly recommend using a strong, unique password and enabling any available security features.
4.4 One Account Per User
Each individual or entity may only maintain one active account on ClawRent. Creating duplicate accounts is strictly prohibited and may result in the termination of all associated accounts.
4.5 Google Sign-In
Where Google OAuth sign-in is offered, your use of that feature is also subject to Google's Terms of Service and Privacy Policy. ClawRent is not responsible for Google's handling of your data.
5.1 Property Owners
As a registered Owner, you are solely responsible for:
- Ensuring all property listings are accurate, complete, and not misleading
- Confirming that you hold legal title to or are authorised to list and rent the property
- Complying with all applicable housing laws, rental regulations, municipal bylaws, and health and safety standards
- Maintaining the property in a habitable and safe condition
- Responding to tenant communications, maintenance requests, and payment queries in a timely manner
- Ensuring that lease agreements comply with the Rental Housing Act and other applicable South African legislation
- Paying all applicable taxes on rental income as required by the South African Revenue Service (SARS)
5.2 Tenants
As a registered Tenant, you are solely responsible for:
- Providing accurate personal and financial information when submitting rental applications
- Paying rent on time as agreed in your lease agreement
- Maintaining the rented property in good condition and reporting maintenance issues promptly
- Complying with the terms of your lease agreement and applicable tenancy laws
- Notifying your Owner and ClawRent of any changes to your occupancy status
5.3 Workers
As a registered Worker, you are solely responsible for:
- Providing accurate information about your skills, qualifications, and availability
- Holding any required licences, certifications, or insurance for the services you offer
- Completing agreed jobs to a professional standard and within agreed timeframes
- Complying with all applicable occupational health and safety regulations
- Any contractual obligations entered into directly with property owners
6.1 Listing Accuracy
All property listings must accurately represent the property being advertised. Misleading descriptions, manipulated photographs, false pricing, or fabricated amenities are strictly prohibited and may result in immediate removal of the listing and termination of the Owner's account.
6.2 ClawRent's Role
ClawRent is a technology platform and not a real estate agency, property management company, or estate agent as defined under South African law. We do not verify the accuracy of listings, inspect properties, or guarantee the quality, safety, legality, or availability of any property listed on the Platform. Users engage with listings entirely at their own risk.
6.3 Prohibited Listings
The following types of listings are strictly prohibited on ClawRent:
- Properties that the lister does not own or have authority to rent or sell
- Properties involved in ongoing legal disputes without disclosure
- Properties intended to be used for illegal activities
- Duplicate listings for the same property
- Fictitious or "ghost" listings designed to collect tenant information
6.4 Removal of Listings
ClawRent reserves the right to remove any listing at any time, for any reason, without prior notice, including but not limited to listings that violate these Terms, applicable law, or that ClawRent determines in its sole discretion to be inappropriate or harmful.
7.1 Payment Processing
ClawRent offers integrated online rent payment functionality through third-party payment processors including but not limited to Paddle, PayPal, Flutterwave, Paystack, and Ozow. By initiating a payment through the Platform, you agree to the applicable terms and conditions of the relevant payment processor.
7.2 ClawRent's Role in Payments
ClawRent acts solely as a technology intermediary facilitating the payment process. We are not a bank, financial institution, or payment service provider. ClawRent does not hold, control, or have access to funds transferred between Tenants and Owners. All payment disputes must be resolved directly between the parties involved and/or the payment processor.
7.3 Manual Payments
The Platform supports manual payment logging (EFT, bank deposit, cash) as a fallback option. For manual payments, the Owner is responsible for verifying and confirming receipt of funds. ClawRent bears no responsibility for unconfirmed, disputed, or fraudulent manual payment claims.
7.4 Payment Records
Payment records displayed on the Platform are for informational purposes only. They do not constitute official financial statements or proof of payment for legal or tax purposes. Users are advised to maintain their own independent financial records.
7.5 Failed or Disputed Payments
ClawRent is not liable for failed transactions, chargebacks, payment reversals, or any financial loss arising from payment processing errors. Users must contact the relevant payment processor directly to resolve such issues.
7.6 Currency
Rent amounts are displayed in the currency set by the Owner. ClawRent does not guarantee exchange rates and is not responsible for currency conversion fees charged by payment processors or financial institutions.
8.1 Subscription Plans
ClawRent offers optional paid subscription plans that grant Users access to premium features, including Verified Badges. The current plans are:
- Verified Tenant — Monthly subscription granting a verified credibility badge on tenant profiles and applications
- Verified Owner — Monthly subscription granting a verified credibility badge on owner profiles and property listings
- Pro Worker — Monthly subscription granting a Pro Worker badge and enhanced visibility in job searches
8.2 Billing
Subscriptions are billed on a monthly recurring basis from the date of initial purchase. Payment is processed through our integrated payment partners. You authorise ClawRent and its payment processors to charge your nominated payment method on a recurring monthly basis until you cancel.
8.3 Cancellation
You may cancel your subscription at any time by contacting us at clawrentapp@gmail.com. Cancellations take effect at the end of the current billing cycle. You will retain access to premium features until that date. No partial refunds are issued for unused portions of a billing period.
8.4 Refund Policy
All subscription payments are final and non-refundable, except where required by applicable consumer protection law. If you believe you have been charged in error, please contact us within 7 days of the charge at clawrentapp@gmail.com.
8.5 Price Changes
ClawRent reserves the right to modify subscription pricing at any time. We will provide at least 30 days' notice of any price increase via email or in-app notification. Continued use of the subscription after the effective date of a price change constitutes your acceptance of the new price.
8.6 Taxes
Subscription prices may be subject to VAT or other applicable taxes depending on your location. You are responsible for any applicable taxes not collected by ClawRent or its payment processors.
The ClawRent job board facilitates connections between property owners seeking maintenance services and workers offering such services. ClawRent is not an employer, staffing agency, or contractor. We do not supervise, direct, or control the work performed by Workers.
All agreements for maintenance work are formed directly and exclusively between the Owner and the Worker. ClawRent is not a party to any such agreement and accepts no liability for:
- The quality, safety, or completion of any work performed
- Any injury, property damage, or financial loss arising from maintenance activities
- Any dispute between an Owner and a Worker regarding payment, quality, or timeline
- Any failure of a Worker to hold required licences, certifications, or insurance
Owners are strongly advised to verify the credentials, insurance, and references of any Worker before engaging their services. Workers are advised to ensure they have appropriate insurance cover before undertaking any job.
The following conduct is strictly prohibited on the ClawRent platform. Violation of any of the following may result in immediate account suspension or termination, and may be reported to relevant law enforcement authorities:
- Posting false, misleading, defamatory, or fraudulent content of any kind
- Impersonating any person, entity, or organisation
- Harassing, threatening, intimidating, or abusing any other user
- Discriminating against any user based on race, gender, religion, nationality, disability, sexual orientation, or any other protected characteristic
- Uploading, transmitting, or distributing malware, viruses, ransomware, or any other harmful code
- Attempting to gain unauthorised access to any system, account, or data on the Platform
- Scraping, crawling, or otherwise extracting data from the Platform without express written permission
- Using the Platform to conduct money laundering, fraud, or any other criminal activity
- Circumventing any technical measures or security features of the Platform
- Reproducing, copying, reselling, or exploiting any part of the Platform for commercial purposes without authorisation
- Using automated bots, scripts, or tools to interact with the Platform
- Creating accounts for the purpose of spamming or conducting unsolicited commercial communications
- Posting content that infringes any intellectual property rights, privacy rights, or other legal rights of any third party
11.1 ClawRent's Intellectual Property
All content, features, functionality, design elements, source code, trademarks, logos, trade names, and other intellectual property on the ClawRent platform are owned by or exclusively licensed to ClawRent and are protected by South African and international copyright, trademark, patent, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any part of ClawRent's intellectual property without our prior express written consent.
11.2 User Content Licence
By uploading, submitting, or posting any Content to the Platform (including photographs, documents, descriptions, and reviews), you grant ClawRent a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content in connection with operating, improving, and promoting the Platform.
You represent and warrant that you own or have the necessary rights to grant this licence, and that your Content does not infringe the rights of any third party.
11.3 Feedback
Any feedback, suggestions, or ideas you provide regarding the Platform may be used by ClawRent freely and without any obligation or compensation to you.
THE CLAWRENT PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
ClawRent does not warrant or represent that:
- The Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components
- Any property listing is accurate, complete, or represents a genuine rental or sale opportunity
- Any User is who they claim to be, or that any User's credentials, qualifications, or representations are accurate
- Any transaction facilitated through the Platform will be completed successfully or without dispute
- The Platform will meet your specific requirements or expectations
- Any defects or errors in the Platform will be corrected
Use of the Platform is entirely at your own risk. You are solely responsible for any decisions you make based on information obtained through ClawRent.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLAWRENT, ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, goodwill, or business opportunities
- Personal injury or property damage of any nature
- Any unauthorised access to or use of our servers or any personal information stored therein
- Any interruption or cessation of transmission to or from the Platform
- Any bugs, viruses, or harmful code transmitted through the Platform by any third party
- Any errors, omissions, or inaccuracies in any content posted on the Platform
- Any disputes between Users of the Platform
- Any financial losses arising from payment processing errors or failures
In no event shall ClawRent's total cumulative liability to you for all claims arising from or related to your use of the Platform exceed the greater of (a) the total amount paid by you to ClawRent in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) ZAR 500 (five hundred rand).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless ClawRent and its directors, officers, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms and Conditions
- Your use of the Platform or any services offered thereon
- Your User Content or any infringement of third-party rights arising therefrom
- Your interactions with other Users, including Owners, Tenants, and Workers
- Your violation of any applicable law, regulation, or third-party right
- Any property transaction, maintenance agreement, or other arrangement entered into through the Platform
15.1 Between Users
ClawRent is not obligated to mediate, arbitrate, or resolve any dispute between Users. All disputes between Owners, Tenants, and Workers are the sole responsibility of the parties involved. ClawRent strongly encourages Users to attempt to resolve disputes amicably and in good faith before seeking legal recourse.
15.2 Disputes with ClawRent
If you have a dispute with ClawRent, you must first contact us at clawrentapp@gmail.com and attempt to resolve the matter informally within 30 days. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA), unless you opt out in writing within 30 days of these Terms becoming applicable to you.
15.3 No Class Actions
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
16.1 Termination by ClawRent
ClawRent reserves the right, in its sole discretion, to suspend or permanently terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or any other ClawRent policy
- Fraudulent, abusive, or harmful conduct
- Requests from law enforcement or other government agencies
- Unexpected technical issues or security concerns
- Extended periods of inactivity
16.2 Termination by You
You may delete your account at any time through your account settings or by contacting us at clawrentapp@gmail.com. Upon deletion, your profile and associated data will be removed in accordance with our Privacy Policy and applicable data retention laws.
16.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. All active subscription billing will stop at the end of the current billing period. Provisions of these Terms that by their nature should survive termination shall do so, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
ClawRent reserves the right to revise, amend, or replace these Terms at any time in our sole discretion. When we make material changes, we will notify you by:
- Sending an email to the address associated with your account
- Displaying a prominent notice on the Platform
- Updating the "Last Updated" date at the top of this document
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must cease using the Platform immediately and may delete your account.
We encourage you to review these Terms periodically to stay informed of any updates.
These Terms and Conditions, and any disputes arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.
Subject to the arbitration clause in Section 15, you hereby irrevocably submit to the exclusive jurisdiction of the courts of the Republic of South Africa for the resolution of any dispute not subject to arbitration.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
19.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ClawRent with respect to your use of the Platform and supersede all prior agreements and understandings.
19.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
19.3 Waiver
ClawRent's failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
19.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without ClawRent's prior written consent. ClawRent may assign these Terms without restriction.
19.5 Force Majeure
ClawRent shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, labour disputes, internet or power outages, or other force majeure events.
